Appeals from citizens and legal entities
The general procedure for filing and reviewing appeals is regulated by the following regulatory legal acts:
- Decree of the President of the Republic of Belarus of October 15, 2007 No. 498 "On additional measures for handling appeals from citizens and legal entities"
- Law of the Republic of Belarus of July 18, 2011 No. 300-Z "On appeals from citizens and legal entities"
- Resolution of the Council of Ministers of the Republic of Belarus of December 30, 2011 No. 1786 "On approval of the Regulation on the procedure for maintaining records on appeals from citizens and legal entities in government agencies, other organizations, and individual entrepreneurs"
Appeals may be submitted by applicants in written or electronic form, or presented orally. Oral appeals are presented during a personal reception. Written appeals are submitted by courier, by mail, during a personal reception, by entering comments and/or suggestions in the book of comments and suggestions.
When sending a written request, please remember the following:
- Appeals are submitted in Belarusian or Russian.
- Written appeals from citizens must contain:
- 2.1 the name and (or) address of the organization or the position of the person to whom the appeal is sent;
- 2.2 the last name, first name, patronymic (if any) or initials of the citizen, the address of his/her place of residence (place of stay);
- 2.3 a statement of the essence of the appeal;
- 2.4 the personal signature of the citizen (citizens).
- Written appeals from legal entities must contain:
- 3.1 the name and (or) address of the organization or the position of the person to whom the appeal is sent;
- 3.2 the full name of the legal entity and its location;
- 3.3 a statement of the essence of the appeal;
- 3.4 the last name, first name, patronymic (if any) or initials of the director or the person authorized to sign appeals in accordance with the established procedure;
- 3.5 the personal signature of the director or the person authorized to sign appeals in accordance with the established procedure, certified by the seal of the legal entity.
- The text of the appeal must be legible. Handwritten appeals must be written in clear, legible handwriting. The use of obscene or offensive words or expressions in appeals is not permitted.
- Written appeals submitted by representatives of applicants must be accompanied by documents confirming their authority.
- Appeals must contain information on the results of their previous consideration with the attachment (if any) of documents confirming this information.
Written requests that do not meet the specified requirements may be left without consideration with notification of citizens within five working days of the reasons for leaving the request without consideration. After the violations have been eliminated, citizens have the right to re-apply to a government agency or other organization (to an official) in the manner prescribed by the Law. Anonymous requests are not subject to consideration, with the exception of requests containing information about a crime being prepared, committed, or already committed. Oral requests from citizens are answered orally. If citizens wish to receive a written response, they must submit a written request. An electronic request must contain the same details as a written request, with the exception of the requirement for a personal signature. The institution's decision on the request may be appealed to a higher government agency or other organization (hereinafter referred to as a higher agency).
